What are DAMAs?

The Australian government and Regional authorities have an official migration agreement known as the Designated Area Migration Agreement (DAMA) . That provides additional flexibility to local firms to meet their market needs, this is done by increasing their skill pool, in contrast to the traditional skilled migration program, through DAMA the Aussie workforce can access a larger  pool of skilled and semi-skilled foreign workers.

The South Australian DAMA offers two distinct lists :

List of skilled occupations – this list covers a broad variety of jobs where there is a skill shortage

Regional occupations list – For particular positions that are in great demand in regional South Australia

The Western Australia DAMA has two separate DAMA agreements, each with a distinct focus :

The Goldfields and Pilbara DAMA – Targets jobs that are essential to the growth of the Pilbara and Golfields areas,

Regional Skilled Migration Scheme (RSMS) DAMA – Focuses more broadly on skilled jobs that are in shortage in regional Western Australia.

Depending on the DAMA ( Pilbara & Goldfields or RSMS ) the various jobs are chosen.

Designated Area Migration Agreements

Overseas workers can operate under the DAMA framework instead of the standard skilled migration program. Regions operate under DAMA to respond to their unique economic needs and labour market conditions.

Covering a defined regional area, the two-tier agreement-based framework, the first tier comes with a five-year deed of agreement, otherwise called the head agreement. Specific labour agreements are drawn in the second tier with employers of a particular region. The territorial agreements list several occupations and agreed terms, conditions and concessions alongside the skilled visa eligibility principles that are negotiated between the parties. Individual labour agreements can be sought once the DAMA head agreement has been recognized for a business in that region.

Features of Individual DAMA Agreements

  • Lasts for at least five years
  • Certain visa classes that fall under it are:
    • TSS or Temporary Skills Shortage Subclass 482
    • Skilled Employer Sponsored Regional (Provisional) Subclass 494
    • ENS or Employer Nominated Scheme visa programs Subclass 186
    • Australian citizens and permanent residents get first priority

Process

  • Employer gains an endorsement from DAR and lodges a labour agreement through ImmiAccount
  • DAMA is approved
  • Business nominates and sponsors the skilled overseas workers
